1. What this document is
These Beta Terms supplement the Terms of Service for the period in which Spheromni is offered as a controlled beta. They add to those terms; they replace nothing in them. Where the two cover the same subject, the Terms of Service govern and this document points at the relevant section rather than restating it.
Nothing here is in effect. Like every document on this site it is a draft prepared for review by qualified counsel, and it carries the same unresolved placeholders.
2. Who may take part
You must hold a Spheromni account, you must have confirmed that you are an adult, and — while the invite requirement is in force — you must have redeemed an invite code. Section 2 of the Terms of Service states the adults-only rule; this section states how it is asked.
The adult confirmation is a statement you make, not a check Spheromni performs. Spheromni collects no date of birth, holds none, and verifies nothing about your age. What is recorded is that you were asked and what you answered, with the date and time. The confirmation is asked for once and cannot be withdrawn through the product — there is no mechanism for un-confirming it, and deleting your account removes it with everything else.
3. Invite codes
An invite code is issued by Spheromni staff and given to you directly. Spheromni sends nothing — no email, no message of any kind — so no code has ever arrived from Spheromni and none ever will. A code works once. Redeeming it records that this account has beta access; the code cannot then be used by anybody else.
Do not share a code you were given: whoever redeems it first takes the access, and there is no way to reverse that. Spheromni may revoke a code that has not been redeemed. Revoking a code does not remove access from an account that has already used it — ending an account's access is a separate act, governed by section 29 of the Terms of Service.
Access to the beta is a permission, not a purchase. Nothing is paid for it, nothing is owed for it, and it may be ended.
4. What a beta is, here
Spheromni is pre-launch software under active development. Features appear, change and are removed; a feature behind a switch may be withdrawn without notice and data associated with it may not survive that. Sections 21 and 23 of the Terms of Service say this and remain the statement of it.
The beta may end, and it may be reset. Ending it may mean access stops. A reset may mean data created during the beta is deleted. Neither is planned as this is written and neither is promised against.
5. Availability, and the absence of any commitment about it
There is no uptime commitment and no service level agreement, in the beta or otherwise. Section 22 of the Terms of Service states this and is not softened here: Spheromni may be unavailable, may be taken down without notice, and may lose data.
There is no backup. Not untested backups — none are configured. There is nothing to restore from, and there is no recovery window after any deletion. Keep your own copies of anything you cannot afford to lose. The known limitations page lists this alongside everything else in the same position.
Nothing monitors Spheromni and nothing raises an alert when it fails. The status page runs one check when you open it and keeps no history of the answer.
6. Feedback
You may send feedback from your account page. You do not have to send any, and nothing in the product depends on whether you do.
When you send feedback, you grant [SPHEROMNI RESPONSIBLE ENTITY — TBD] a non-exclusive, worldwide, royalty-free, perpetual licence to use it to operate, improve and develop Spheromni — including to build what you suggested — without any obligation to you, without any compensation, and without any obligation of confidence in respect of it. You confirm that you are entitled to send what you send.
This licence covers what you write in the feedback form and nothing else. It grants no right over your files, your notes, your workspace or anything else you store in Spheromni; sections 8 and 9 of the Terms of Service govern those and are unchanged. Do not put anything confidential, and nothing about another person, into a feedback message.
A written reply, if there is one, appears on your account page and nowhere else. You will not be notified, because Spheromni sends no message of any kind. There is no commitment to reply at all and no time by which a reply will come; how requests are handled is described in docs/operations/support-workflow.md, which sets no deadline either.
7. Confidentiality
Nothing in the beta is confidential to you and nothing is asked of you in return for taking part. You may say what you like about Spheromni publicly. There is no embargo, no non-disclosure obligation and no approval process for anything you write about it.
8. Ending participation
You can stop at any time by not signing in, and you can delete your account yourself from Settings, under Privacy — immediately and irreversibly, as section 29 of the Terms of Service describes.
Spheromni may end your beta access, with or without ending your account, including where the Acceptable Use Policy or the Terms of Service have been breached. Where that happens the reason is recorded in Spheromni's administrative records. You will not be told by message, because there is no message to send; you find out by opening the product.
9. Everything else
Warranties, liability, indemnity, governing law and dispute resolution are sections 31 to 35 of the Terms of Service and apply unchanged to beta participation. Those sections are drafts too, and two of their terms are unresolved placeholders. Governing law is [PRIMARY JURISDICTION — TBD].
What Spheromni does with the data the beta adds — the record of your adult confirmation, the record that a code was redeemed, your feedback, and error reports if you turned them on — is in the Beta Privacy Notice, which supplements the Privacy Notice in the same way this document supplements the Terms.
